The EM app uses location and date, time stamp information to provide you with relevant picture content and improve your user experience. You can always change your location settings if you don’t agree to share your location.

We respect your privacy and use your location data only in ways that is allowed in this terms and conditions and will not share your data to any third party without your consent.

Any person that does not wish to disclose their photos will need to raise this with the party organisers and is not a personal responsibility of EM App.

EM app will use usage data to improve its information and output in the mEMntime provide the relevant data you require. You can decline to share your usage data by changing the settings in the app but it can also limit some other features in the app.

The EM app will collect a few information from users such as name, email address, phone numbers, time stamps of photos. We collect this information to validate our users and provide relevant content and improve the app. We do not sell or share your information with third parties without your permission, except when required by law.

We take precautions to secure your information for the purposes for which we collected it for and will prevent it from being shared by third parties. However, we cannot guarantee that third parties will not have access to your information, for example in cases of hacking or unauthorised access,

Use of EM App

You may only use the EM app for legal purposes. It is not allowed to use the EM app for any illegal purposes that is harmful to other users. You are also not allowed to use the app in a way that overloads or damages our servers.

Intellectual property rights:

The EM app and the accompanying content, includes images and texts and these are protected by intellectual rights of EM apps and third-party.

You can use the EM app and accompanying content for personal purposes provided you include a source attribution and do not modify or adapt the EM app and associated content.

EM reserves the rights to modify, remove or terminate the app without prior written notice or directions. EM is not responsible for any damages you may incur as a result of changes, removals or terminations of the EM app and related content.

You are responsible for complying with the intellectual property rights of third parties and indemnity against any claims from third parties arising from the use of the EM app and related content.

Liability

EM is not liable for any direct or indirect, special, or consequential damages resulting from the use of the app. This also applies to any damages arising from any errors, omissions, delays or the non-transmission of information of the unauthorised use of data provided by the app or other services offered by the EM app.

The EM team has worked hard to ensure that the app is free from errors and the data we provide is accurate, however we cannot guarantee this.

We are also not liable for any indirect, consequential damages or loss of profits resulting from the use of the app. This also applies to damages or loss resulting from the use of EM app by third parties.

We are not liable for any damages or loss because of the use of the app on a device or in any way that is not permitted by these terms and conditions.

License:

You may share the photos and other content you create with the EM app on social media or in other ways, provided that this is only done for personal use. Unless otherwise stated EM and its licensors own the intellectual property rights for all data on EM app. You have access to this from EM app for your own personal use, subject to the limitations set out in these terms and conditions.

You are not allowed to:

  • Sell, rent or sublicense material from Event Memories.
  • Reproduce,duplicate or copy material from Event Memories
  • Redistribute content from the Event Memories

By sharing this app, users are given the permission to post and exchange feedbacks, information and content on certain parts of the app. EA app does not filter,edit,publish or review opinions, information and content before their presence on the app. Comments reflect the views and opinions of the person posting their views and opinions.

Event Memories reserves the rights to review all opinions, information and content and remove any content that is illegal or inappropriate, offensive or that violates these terms and conditions.

Hyperlinks to our content:

The following organisations may link to our app without prior written permission:

  • Government agencies;
  • Search engines;
  • News organisations;
  • Online directory distributors may link to our app in the same manner as they hyperlink to the websites of other listed companies; and
  • Systemwide Accredited Businesses except soliciting non-profit organisations, charity shopping malls, and charity fundraising groups which may not hyperlink to our app.
  • These organisations may link to our app, publications, or other website information as long as the link: (a) is not misleading; (b) does not imply falsely that Event Memories or any of its products or services are endorsed by or sponsored by the linking party; and (c) fits within the context of the linking party's site.

We will consider and approve other link requests from the following types of organisations:

  • general information sources for consumers and/or businesses;
  • Dotsquares
  • associations or other groups representing charitable or philanthropic causes;
  • online directory distributors;
  • internet portals;
  • accounting, law and consulting firms; and
  • educational institutions and trade associations.

We will approve link requests from these organisations if we decide that:

  • (a) the link would not make us look bad for ourselves or for our accredited businesses;
  • (b) the organisation does not have negative information about us;
  • (c) the benefit to us from the visibility of the hyperlink outweighs the absence of Event Memories; and

These organisations may link to our homepage as long as the link:

  • (a) is not misleading in any way;

Using the Event Memories logo or other artwork is not permitted for linking without a trademark license agreement.

User Conduct

As a user of our app, you are responsible for your own conduct and behavior while using our services. You agree to use our app only for lawful purposes and in a manner that does not infringe upon the rights of others or inhibit others from using our services.

You are expressly prohibited from using our app to engage in any of the following activities:

  • Violating any applicable laws, regulations, or third-party rights, including intellectual property, privacy, or publicity rights.

You are also prohibited from using our app in a way that could damage, disable, overburden, or impair our services or servers, or interfere with any other party's use and enjoyment of our services.

We reserve the right to remove or disable access to any content or account that violates these terms, and we may take appropriate legal action against any user who violates these terms.

If you encounter any inappropriate behavior from other users while using our app, please report it immediately for customer service mail at - eventalbum45@gmail.com. We reserve the right to take appropriate action against any user who engages in such behavior, including the removal of their account and possible legal action.

By using our app, you acknowledge that you have read, understood, and agreed to abide by these user conduct guidelines.

Liability for content:

We cannot be held responsible for any content that appears on your app. You agree to protect and defend us against all claims filed on your app. No links on an app may appear that can be interpreted as defamatory, obscene, or criminal, or that infringe, otherwise violate, or advocate for the infringement or other violation of the rights of third parties.

Reservation of Rights:

We reserve the right to request that you remove all links or any particular link to our app. You agree to immediately remove all links to our website upon request. We also reserve the right to modify these terms and conditions and linking policy at any time. By continuing to link to our app, you agree to be bound by and abide by these linking terms and conditions.

Removal of opinions, information, and content from our website:

If you find any opinions, information, and content on our app that are offensive for any reason, you can contact us at any time and let us know. We will consider requests to remove links, but we are not obligated to directly respond to you.

We do not ensure that the information on this app is correct. We do not guarantee completeness or accuracy, nor do we promise to keep the website available or keep the material on the website up to date.

In-app purchases:

The Event Memories app offers the option to make in-app purchases such as purchasing additional photos, filters, or overlays. All in-app purchases are completely optional and are not necessary to use the app.

All in-app purchases are final and non-refundable transactions. You may only make in-app purchases with your own funds and not with the funds of others without their permission.

We reserve the right to change the prices of in-app purchases and to add new in-app purchases or remove existing in-app purchases without notice.

Once you make a purchase, you will not be able to receive a refund, even if the final content you receive is not to your liking or if you change your mind. Therefore, we recommend that you carefully consider whether you want to make an in-app purchase before doing so.

It is your responsibility to check that you are making the correct in-app purchases and to ensure that you are paying the correct amount. We cannot provide refunds for incorrect or duplicate in-app purchases unless legally required to do so.

Changes to the Terms of Service:

Event Memories reserves the right to modify these Terms of Service at any time. It is the responsibility of the user to regularly review the Terms of Service to stay informed of any changes. Use of the app after the announcement of changes to the Terms of Service is considered acceptance of those changes.

Termination of the User Agreement:

Event Memories reserves the right to terminate the User Agreement at any time without prior notice. If the User Agreement is terminated, your location and usage data will be removed from our servers. We will also block your access to the app.

Account Deletion:

Users have the option to delete their account within the app. To initiate this process, they should navigate to "Setting," where they will find the "Delete Account" button. Upon clicking the "Delete Account" button, a confirmation prompt will appear. Once the user confirms, their account will be permanently deleted. This includes the removal of the user's email address and all associated reminders from the app.

Disclaimer:

To the maximum extent permitted by applicable law, we exclude all statements, warranties, and terms in relation to our website and the use of this website. Nothing in this disclaimer will:

  • limit or exclude our or your liability for death or personal injury;
  • limit or exclude our or your liability for fraud or fraudulent misrepresentation;
  • limit any of our or your liabilities in any way that is not permitted under applicable law; or
  • exclude any of our or your liabilities that may not be excluded under applicable law.

As long as the app and the information and services on the app are provided free of charge, we will not be liable for any loss or damage of any nature.
